How to Fight Multiple Drug Charges

If you have been hit with multiple drug charges, it is very important that you hire an attorney who has experience with each type of charge you’re facing. This is because you will need to build a defense that addresses every single charge against you.

Defenses for Drug Charges in Nashville

Some of these defenses include:

  • Your due process rights were violated, such as in an illegal search and seizure

  • The substance wasn’t a drug, as shown by a crime lab analysis

  • The evidence (the seized drug) has been lost

  • The drug belongs to someone else

  • The drugs were planted

Just because the case against you seems strong, doesn’t mean it is. Our team at Andrew C. Beasley, PLLC will carefully investigate the case against you to find any holes, rights violations, and which defenses are most appropriate. We are often able to get certain (or all) charges dropped or dismissed, especially if the prosecution is pursuing charges far harsher than what the law calls for.

What are the Penalties for Drug Crimes in Tennessee?

Drug charges are not to be taken lightly.

These crimes can result in penalties such as:

  • Hefty fines

  • Probation

  • Imprisonment

  • Community service

  • Permanent mark on your criminal record

Drug Offenses in Nashville

The sooner you hire my firm, the sooner I can begin building a strong defense that is designed to prevent you from enduring such harsh penalties and consequences.

If you are accused of any of the following types of drug crimes, do not wait to contact my office.

What Factors Determine the Penalty for Drug Possession?

It is illegal to possess certain substances in Tennessee and the U.S. If you are caught with these drugs on your person or on your property, you could be charged with drug possession.

Which drug you are caught with and how much of it you have will determine the penalty. Where you are caught to be allegedly in possession of drugs will also affect your case, such as if you were in a drug-free zone.

Possession with the Intent to Sell

This charge takes drug possession a step further, as it applies to cases in which the prosecution alleges the defendant had plans to sell the drugs they were found with.

Unfortunately, a charge for possession with the intent to sell can be brought even if you have a clean criminal record.

Drug Trafficking and Distribution

A charge for drug trafficking alleges that the defendant was transporting, importing, or selling illegal substances. This charge is also known as “drug distribution.”

Again, the type of drug, how the federal government classifies it (between Schedule I and V under the Controlled Substances Act), and how much was being trafficked will affect your case. If a defendant is charged for trafficking drugs across state lines, then they will need to be tried under federal law instead of state law.

Drug Manufacturing

This charge refers to the manufacturing of synthetic drugs, such as methamphetamine, heroin, and LSD. In Tennessee, it can also apply to growing and cultivating cannabis.

A charge for drug manufacturing can carry heavy penalties, even if you're not the one who sells the drug.

Marijuana-Related Charges

There are a variety of marijuana charges, ranging from minor charges like possession to severe charges like trafficking.

Although marijuana is one of the most commonly used drugs, the federal government still classifies it as a Schedule I illegal substance. And the state of Tennessee takes any criminal case involving marijuana very seriously.

For example, possession of marijuana paraphernalia is a misdemeanor charge punishable by up to 1 year in jail and $2,500 in fines.
