DUI Penalties in Tennessee

Whether this is their first DUI offense or second offense, one of the first questions clients ask is on what penalties will face for their charges. Remember, you are innocent until proven guilty, so your focus should be building your defense, not embracing for penalties! However, knowing what to expect can be helpful when crafting a strategy to withstand the prosecution attacks.

In Tennessee, the consequences for DUI can include:

  • Heavy fines, including restitution, court fees, and towing expenses
  • Varying jail times depending on level of intoxication
  • Driver's license suspension
  • Alcohol and drug treatment programs
  • Potential for ignition interlock device installation on your vehicle

Even if you refused or failed your field sobriety tests in Nashville, you must make sure you are aggressively represented by a Nashville DUI lawyer through all legal proceedings. The sooner you start working on your defense, the more effective it will likely be.

What is an Ignition Interlock Device?

This is a device that is installed in a driver's car requiring them to give a breath sample before the car starts. An IID (ignition interlock device) may be installed for even a first-offense DUI. In the case of a DUI conviction within a 5-year period, an IID will be required for 6 months after the license is given back.

Implied Consent Law in Tennessee

In Tennessee, the implied consent law specifies that if an individual drives a vehicle they automatically consent to a breath test determining their BAC. If a police officer has probable cause to believe the driver is under the influence, they may request them to take a breath test. The "implied consent" law does not include requirement of blood tests in Tennessee. The driver will not be penalized for refusing a breath test.

Crafting Unique Defenses for Each Client

Whether you find yourself facing your second DUI offense for just barely being over the legal limit or arrested for your first offense after having one or two drinks during a night out with friends, it is crucial that you begin work on your defense right away. Keep in mind that each case is unique and will require a defense specifically crafted around the circumstances involved.

Depending on the case, the following can be used as defenses against DUI charges:

  • Negotiate your charges down to a wet reckless if it is a first offense
  • Argue that there is not sufficient evidence to charge you
  • Demonstrate that a chemical test was administered incorrectly
  • Prove that the breathalyzer machine was not calibrated properly
  • Challenge a police officer’s testimony with outside witnesses
  • Bring in expert witnesses to contrast the chemical test results
  • Show that your rights were violated when evidence was obtained

All of these strategies can be employed to not only strengthen your own case, but to weaken the prosecution’s. Without definitive proof and convincing testimony, a guilty verdict can be difficult to secure. Remember, a defendant must be proven guilty beyond reasonable doubt. It is my job to create this reasonable doubt and present your side of the story. With my legal team on your side, you can be confident that an effective and strategic defense will be utilized to clear your name.
