What are the DUI Penalties in Tennessee

Whether this is their first DUI offense or second offense, one of the first questions clients ask is on what penalties they will face for their charges. Remember, you are innocent until proven guilty, so your focus should be on building your defense, not bracing for penalties! However, knowing what to expect can be helpful when crafting a strategy to withstand the prosecution attacks.

In Tennessee, the consequences for DUI can include:

  • Heavy fines, including restitution, court fees, and towing expenses
  • Varying jail times depending on level of intoxication
  • Driver's license suspension
  • Alcohol and drug treatment programs
  • Potential for ignition interlock device installation on your vehicle

Underage DUI

Underage DUI refers to drivers who are under the age of 21 and are charged with driving under the influence. In TN, sometimes underage drivers may face lighter sentences than drivers who are over 21 and are charged with DUI. In order for an individual to qualify for underage DUI charges, they must be under the age of 21, and have had a BAC of at least .02% but less than .08%.

Underage DUI penalties in Tennessee can include the following:

  • A $250 fine
  • A one-year license suspension

The benefits of receiving underage DUI penalties vs. standard DUI penalties is that the individual is able to avoid serving any jail time, and the incident will usually appear on their record as either a misdemeanor or a delinquent act. It is usually up to the prosecutor whether they choose to charge the individual with a standard DUI or an underage DUI.

Out of State DUI

If you were previously convicted for DUI, even if it was in another state, that previous conviction may still be used against you in a Tennessee DUI case and could lead to steeper penalties. Tennessee honors DUI convictions from every other state in the country. However, if this prior conviction is going to be used to support a stronger sentence in Tennessee, the prosecutor will need to provide the time, place and location of the prior conviction.

DUI License Suspension

License suspension is a common Tennessee DUI penalty. Depending on the type of offense you commit, your license suspension period could last anywhere from one year to six.

DUI license suspension penalties in TN include:

  • First Offense - License suspension for one year
  • Second Offense - License suspension for two years
  • Third Offense - License suspension for six years

What is an Ignition Interlock Device?

This is a device that is installed in a driver's car requiring them to give a breath sample before the car starts. An IID (ignition interlock device) may be installed for even a first-offense DUI. In the case of a DUI conviction within a 5-year period, an IID will be required for 6 months after the license is given back.

Implied Consent Law in Tennessee

In Tennessee, the implied consent law specifies that if an individual drives a vehicle they automatically consent to a breath test determining their BAC. If a police officer has probable cause to believe the driver is under the influence, they may request them to take a breath test. The "implied consent" law does not include requirement of blood tests in Tennessee. The driver will not be penalized for refusing a breath test.
